Lease Termination Letter Template

Unwritten lease termination becomes a $3,000 dispute. Template covers mutual and landlord-initiated terms for CA, TX, FL, NY, WA.

Most lease terminations happen smoothly, the lease ends, the tenant moves out, everyone moves on. But when there's any ambiguity (early termination, mutual agreement, disputed move-out date, or a landlord breach claim), the absence of a written termination letter creates a $1,500-$5,000 liability gap. A signed lease termination letter closes the loop on the tenancy, documents the final move-out date, and establishes what deposit deductions are or aren't in play.

What Is a Lease Termination Letter?

A lease termination letter is a written document formally ending a lease agreement. It differs from a notice to vacate (which gives notice that a tenancy will end) and from an eviction notice (which responds to a breach), the termination letter is the final, mutually acknowledged record that the lease is over.

Lease termination letters are used in three scenarios:

  1. Mutual early termination. Both parties agree to end the lease before its stated expiration date
  2. Landlord-initiated termination. The landlord ends the lease at expiration (not renewing) or exercises a lease-break clause
  3. Tenant-initiated termination. The tenant gives notice of early termination (their letter to you; you may respond with this template to confirm acceptance)

When to Use This Template

  • At the end of a fixed-term lease you are not renewing. This is cleaner than relying solely on the lease expiration clause; it documents the final date in writing
  • When both parties agree to early termination. Protects both parties from later claims about what was "agreed to"
  • When a tenant invokes a military or domestic violence lease break clause. Federal and state laws require honoring these; the termination letter documents that you have
  • When you are offering a buyout to a tenant. Combine with a settlement agreement specifying what the tenant receives in exchange for vacating early
  • After serving a notice to vacate that the tenant has acknowledged. Confirms the agreed move-out date

What to Include in a Lease Termination Letter

1. Both parties' full names. Landlord/management company and all named tenants.

2. Property address. As stated in the lease.

3. Lease start date and original termination date. Establishes the contract being terminated.

4. Agreed termination / move-out date. The specific date by which the tenant will vacate and return keys.

5. Security deposit terms. State the deposit amount, the timeline for return, and any known deductions, or commit to a post-move-out inspection and itemized statement.

6. Early termination fee (if applicable). If the lease requires a buyout fee for early termination, state the amount and due date.

7. Final rent proration (if applicable). If terminating mid-month, calculate the prorated rent owed through the move-out date.

8. Outstanding obligations. Any utilities, keys, parking passes, or other items that must be settled at move-out.

9. Release of claims (optional). For mutual terminations, both parties may agree to release each other from future claims arising from the tenancy.

10. Signatures from both parties. Both landlord and all tenants should sign and date. Unsigned termination letters are not binding.

LEASE TERMINATION AGREEMENT

This Lease Termination Agreement ("Agreement") is entered into as of [DATE] between:

Landlord: [LANDLORD NAME / MANAGEMENT COMPANY], [LANDLORD ADDRESS]

Tenant(s): [TENANT FULL LEGAL NAME(S)], currently residing at [PROPERTY ADDRESS, UNIT NUMBER], [CITY, STATE ZIP]

WHEREAS, the parties entered into a Lease Agreement dated [ORIGINAL LEASE DATE] for the above-described premises; and

WHEREAS, both parties wish to terminate said Lease Agreement under the terms set forth herein;

NOW THEREFORE, the parties agree as follows:

1. Termination Date. The Lease Agreement shall terminate, and Tenant shall vacate and surrender the premises, on or before [MOVE-OUT DATE] ("Termination Date"). Time is of the essence.

2. Early Termination Fee. [CHECK ONE]

  • No early termination fee applies. The lease is being terminated by mutual agreement without penalty.
  • Tenant agrees to pay an early termination fee of $[AMOUNT], due on [DATE], as a condition of this Agreement.

3. Final Month Rent. Tenant owes prorated rent of $[PRORATED AMOUNT] for the period [START DATE] through [TERMINATION DATE], due on [DUE DATE].

4. Security Deposit. Landlord holds a security deposit of $[DEPOSIT AMOUNT]. Following Tenant's vacation and a move-out inspection, Landlord will return the deposit (less any lawful deductions for damages beyond normal wear and tear) within [STATE-REQUIRED DAYS] days of the Termination Date. An itemized statement of any deductions will be provided.

5. Move-Out Requirements. Tenant agrees to: (a) vacate and remove all personal property by the Termination Date; (b) return all keys, access cards, fobs, and parking passes to [RETURN LOCATION]; (c) leave the premises in the same condition as at move-in, less normal wear and tear; and (d) schedule a move-out inspection with [CONTACT NAME] at [PHONE / EMAIL] at least [X] days before the Termination Date.

6. Outstanding Utilities. Tenant is responsible for utility accounts in their name through the Termination Date and must transfer or cancel all utility accounts effective [DATE].

7. Release of Claims. [OPTIONAL] Upon fulfillment of the terms of this Agreement, each party releases the other from all claims, demands, and liabilities arising from or related to the Lease Agreement and the tenancy, except as expressly preserved herein.

8. Governing Law. This Agreement shall be governed by the laws of the State of [STATE].

State-Specific Considerations

California

  • Early termination by tenant for domestic violence: Tenants who are victims of domestic violence, sexual assault, stalking, human trafficking, or elder/dependent adult abuse may terminate with 14 days' notice (Civil Code §1946.7). Landlord cannot charge a fee or withhold deposit for this termination.
  • Military termination: Active duty military members may terminate with 30 days' written notice under the Servicemembers Civil Relief Act (SCRA) and Civil Code §1951.1.
  • Deposit return: 21 days after Tenant vacates (Civil Code §1950.5). Send itemized statement with remaining deposit by certified mail.
  • Just cause (AB 1482 covered properties): Mutual termination is not subject to just-cause requirements, but document the agreement carefully to avoid future claims.

Texas

  • Military termination: 30 days' written notice under SCRA; no early termination penalty allowed.
  • Domestic violence: Texas Property Code §92.016 allows victims to terminate with 30 days' written notice; landlord may not charge a lease break fee.
  • Deposit return: 30 days after tenant vacates and provides forwarding address (Property Code §92.103).

Florida

  • Military termination: 30 days under SCRA; also F.S. §83.682 for National Guard and reserves.
  • Deposit return: 15 days if no deductions; 30 days with itemized deduction statement (F.S. §83.49).

New York

  • Military termination: 30 days under SCRA.
  • Domestic violence: RPL §227-c allows termination with 30 days' written notice; one month's rent forfeit may apply depending on circumstances.
  • Deposit return: Within 14 days of tenancy end and tenant providing forwarding address (GOL §7-108).

Washington

  • Deposit return: 30 days after Tenant vacates and provides forwarding address, or 14 days if no deductions (RCW 59.18.280).
  • Domestic violence: RCW 59.18.575 allows termination with 20 days' notice for documented domestic violence victims.

How to Customize This Template

Prorate the final month: If the move-out date is mid-month, calculate the prorated rent: (monthly rent ÷ days in month) × days occupied. Use the actual days in the month, not 30. Include this figure in Section 3 to avoid post-move-out disputes about final payment.

Early termination fee vs. buyout: An early termination fee is a lease-stipulated charge (typically 1-2 months' rent) for breaking the lease. A buyout is a negotiated payment you offer the tenant to vacate early. These are different in character: the fee is punitive (the tenant broke the contract); the buyout is an incentive (you want them out before the lease expires). Name them correctly in the letter.

Do not release claims prematurely: The optional "release of claims" clause in Section 7 should only be used when both parties are satisfied the tenancy ended cleanly. If you expect deduction disputes, delete this clause and handle disputes through the normal deposit itemization process.

Common Mistakes

Not getting the tenant's signature. A termination letter signed only by the landlord is a notice, not an agreement. For mutual terminations, you need both parties' signatures. Unsigned "agreements" are routinely disputed in small claims court.

Forgetting to specify key return logistics. "Return the keys" is not sufficient. Specify where, to whom, by when, and what happens if they're not returned (lost key fee per lease section). Tenants who forget to return keys often claim they returned them to "the front door" or "the mailbox."

Skipping the deposit accounting discussion. If you know of likely deductions (cleaning, pet damage, missing fixtures), flag them in the termination letter rather than surprising the tenant with the itemized statement 21-30 days later. A brief heads-up reduces disputes and bad reviews.
